Know Your Weingarten Rights!

🔵 USW LOCAL 14637
📚 UNION EDUCATION WEDNESDAY

This Week’s Topic: KNOW YOUR WEINGARTEN RIGHTS!

Did you know that, as a union-represented employee, you have the right to request union representation during an investigatory interview that you reasonably believe could lead to disciplinary action?

These protections are known as Weingarten Rights.

🛡️ WHAT DOES THIS MEAN FOR YOU?

If management begins questioning you about something that could potentially result in discipline, you have the right to request a union representative.

✅ IMPORTANT THINGS TO REMEMBER:

  • You must request union representation. Management generally isn’t required to remind you of this right.
  • Once you request representation, management generally cannot continue the investigatory questioning without honoring your rights.
  • You do not have to face a potentially disciplinary investigation alone.
  • These rights apply to investigatory interviews, not every conversation with management.

🗣️ WHAT SHOULD YOU SAY?

“If this discussion could in any way lead to my being disciplined or terminated, I respectfully request that my union representative be present before answering questions.”

💪 KNOWLEDGE IS PROTECTION!

Our union is only as strong as its informed and united membership.

As your elected union representatives, we are committed to helping every member understand their rights, protections, and the importance of standing together.

An informed membership is a stronger membership!

Understanding Your Grievance Rights

💙💛 USW LOCAL 14637 💛💙

📖 KNOW YOUR CONTRACT WEDNESDAY

✊ WEEK 1: UNDERSTANDING YOUR GRIEVANCE RIGHTS

Did you know that our collective bargaining agreement provides a formal process for addressing potential contract violations?

As union members, it’s important that we understand our rights and the procedures available to protect them.

📜 ARTICLE 33 – GRIEVANCE AND ARBITRATION PROCEDURE

Under Section A, a grievance involves a dispute or complaint concerning the interpretation, application, or compliance with our collective bargaining agreement.

⚖️ HOW DOES THE PROCESS WORK?

🔹 Step 1: A formal grievance must generally be raised with your immediate supervisor within 3 working days after the issue comes to the employee’s or Union’s attention.

🔹 Step 2: If unresolved, the grievance can proceed in writing through the Union’s Grievance Committee.

🔹 Step 3: Unresolved grievances may advance to ARH’s Community CEO.

🔹 Step 4: The designated International Union representative may advance unresolved grievances to the designated ARH representative.

⏰ IMPORTANT: DEADLINES MATTER!

Our contract establishes specific time limits for each step. Suspension and discharge grievances also have special procedures and deadlines.

🤝 WHY DOES THIS MATTER?

Your union is here to help ensure that our negotiated agreement is followed and that concerns are addressed through the proper process.

If you believe your contractual rights may have been violated, contact a union representative promptly. Don’t wait until a deadline has passed!

💙 AN INFORMED MEMBERSHIP IS A STRONGER MEMBERSHIP! 💛

Every Wednesday, we’ll highlight another section of our contract to help members better understand their rights and protections.
